5.2        Submissions on the Freedom Camping Bylaw, Revocation of Reserve Status - 583 Belvedere Road (Belvedere Hall) and Disposal of 29 Holloway Street

 

1.              Purpose

For the Committee to be provided with the submissions on the proposed Freedom Camping Bylaw, Revocation of Reserve Status – 583 Belvedere Road (Belvedere Hall) and Disposal of 29 Holloway Street.

2.              Significance

Section 82 of the Local Government Act 2002 (LGA) sets out principles of consultation which must be met when undertaking consultation.

The recommendation to receive and hear submissions on the CDC Freedom Camping Bylaw, Revocation of Reserve Status - 583 Belvedere Road (Belvedere Hall) and Disposal of 29 Holloway Street does not trigger any additional criteria under the Significance and Engagement Policy.

3.              Background

Carterton District Council agreed to undertake consultation on the Freedom Camping Bylaw, the Revocation of Reserve Status of Belvedere Hall (583 Belvedere Road) and Disposal of 29 Holloway Street.

Included in Attachment 1 is a copy of the submission documents.  

Consultation

A combined consultation occurred between 2 June 2023 and 2 July 2023.

The consultation document and submission forms were available on our website, and from the Council buildings (28 Holloway Street and the Carterton Events Centre, 50 Holloway Street). The opportunity to submit was advertised to our community via the Wairarapa Times Age, the Midweek and through our Social Media channels.

4.              Submissions

A full set of submissions received are included in this report as Attachment 2.  A copy of all submissions will also be available on our website.

The schedule of submitters who will speak to their submission is:

·    2 submitters will speak on Freedom Camping – 9 am, Wednesday 22 August

·    2 submitters will speak on the sale of 29 Holloway St – 9.15 am, Wednesday 22 August

A total of 17 submissions were received. Some submitters commented on more than one item. 

·    14 submissions were made on-line

·    1 was completed on a hard copy submission form

·    2 submissions were provided by email or letter

·    6 provided comment for the Disposal of 29 Holloway Street

·    4 provided comment for Freedom Camping Bylaw

·    2 provided comment for Revocation of Reserve Status of Belvedere Hall (583 Belvedere Road).

Officer’s responses, comments and recommendations are included in the submissions document (Attachment 2).

5.              Next steps

The Hearings Committee will discuss the submissions received, the submission analysis and the proposed recommendations. They will consider the views of the community and advice from staff and make decisions at a public-excluded Deliberations Meeting following the Hearing.

Analysis of the submissions, trends and the outcome of the deliberations will be presented to Council as part of the Deliberation Report, at the September Ordinary Council meeting.

6.              CONSIDERATIONS

6.1      Climate change

There are no climate change impacts or considerations arising from the receipt of this report. The deliberations report will comment on any key themes related to Climate Change that are noted in submissions.

6.2      Tāngata whenua

There are no specific implications for Māori arising from the receipt or hearing of submissions.

6.3      Financial impact

There are no specific financial considerations associated with the receipt or hearing of submissions.

6.4      Community Engagement requirements

The opportunity to be heard was outlined in the submission form.

Following the deliberations meeting, council decisions on the three consultation items will be communicated to submitters and the community. 

6.5      Risks

There are no specific risks identified with the receipt or hearing of submissions.

 

7.              Recommendation

That the Committee:

1.        Receives the full set of submissions on the proposed CDC Freedom Camping Bylaw, Revocation of Reserve Status of Belvedere Hall (583 Belvedere Road) and Disposal of 29 Holloway Street. 

(a)      Notes that 17 submissions were received.

(b)      Notes of these submissions 4 are confirmed to be heard.

2.        Notes that a public-excluded Deliberations Meeting will be held following the hearing.
